These general conditions of sale govern the relations between Miniatures Realm, and the customer in relation to the purchase of products made remotely through the use of the telematic network, on the website www.miniaturesrealm.com. Although not expressly governed by these general conditions of sale, please refer to the provisions of Legislative Decree 22 May 1999 n. 185 and the applicable regulations of the Civil Code. As regards the protection of confidentiality, it will be subject to the legislation referred to in Legislative Decree 30 June 2003 n.196.
Definitions
Miniatures Realm: indicates Miniatures Realm, sole proprietorship registered with the CCIA and Part. VAT 12349860010.
Customer: indicates the consumer or the natural person who, in relation to sales contracts concluded with Miniatures Realm, acts for purposes unrelated to any entrepreneurial or professional activity carried out.
User: indicates any user of the site even if he / she does not have a personal or commercial account.
Parties: means Miniatures Realm and the client jointly.
Site: indicates the website www. miniaturesrealm.com owned by Simone Paris.
Products: indicates the goods sold by Miniatures Realm to the customer indicated in the Order Confirmation and having the characteristics and qualities described on the Site.
Contract: indicates the agreement, governed by these general conditions of sale, concluded between Miniatures Realm and the customer following the acceptance by Miniatures Realm of the Order Confirmation, under which Miniatures Realm undertakes to deliver to the customer the Products, according to the methods and terms specified below.
Order Confirmation: indicates the customer's acceptance, forwarded to Miniatures Realm by electronic transmission, of the unit price of the Product (or the total price of the Products, in case of purchase of more goods), of the transport costs, of the characteristics and quality of the Product (or Products) and of the provisions contained in these general conditions of sale.
Conclusion and object of the Agreement
The receipt by Miniatures Realm of the Order Confirmation, sent by the customer by electronic transmission, determines the conclusion of the Contract. With the conclusion of the Agreement, Miniatures Realm undertakes to supply the customer with the Products, under the terms and conditions set forth in these general conditions of sale, without prejudice to the right of Miniatures Realm not to process orders against subjects who do not give sufficient guarantees of solvency.
The customer, both by registering a personal account and, subsequently and even more so by sending the Order Confirmation, unconditionally accepts and undertakes to observe, in relations with Miniatures Realm, the provisions contained in these General Conditions of sale and use of the service.
Both the registration and login on the site, and the use of the same as a simple user, and the forwarding of the Order Confirmation, therefore, imply the full knowledge and acceptance without reservation of these General Conditions of sale and use of the service as well as additional information contained in the web pages of the Site referred to therein and connected via links.
Once the Contract is concluded with the receipt of the Order Confirmation by Miniatures Realm, the latter will send the customer an e-mail message containing the details of the relative order (prices, quantities and characteristics of the Products), with the assignment of a Order Number 'which must be used in any further communication with Miniatures Realm.
Unpaid orders will be automatically canceled within 24 hours by the system, canceling any obligation for the client and for Miniatures Realm.
Miniatures Realm accepts orders for products within the limits of existing quantities in stock. Therefore the acceptance of the purchase proposal is subject to the availability of the products in stock. Miniatures Realm undertakes to promptly notify the customer of any unforeseeable out-of-stock due to excess demand or other causes.
Miniatures Realm will then verify the actual availability of the requested goods in stock and will communicate the actual acceptance of the order. Incomplete orders will not be shipped without authorization from the customer.
Commercial guarantees
Miniatures Realm sells only top quality miniatures on the Site, purchasing directly from carefully selected manufacturers and realizing them with the aid of 3D printers. Therefore, Miniatures Realm does not resell used, irregular or inferior quality objects to the corresponding standards offered on the market, unless they are appropriately specified in the description and title of the product and documented with relative photographs.
